TikTok star Emilie Kiser wins legal battle after son, 3, tragically drowned in family pool

A judge has ruled in favor of TikTok star Emilie Kiser, allowing her to block certain details about her three-year-old son Trigg’s death from public records. Trigg fell into the family’s Arizona pool on May 12 and died six days later.

Police said the toddler was playing near the unsecured pool when he tripped and fell in. He was unsupervised for more than nine minutes and in the water for about seven minutes. Charges once considered against Kiser’s husband were later dropped.

Kiser sued to stop the release of sensitive records, including surveillance footage, autopsy reports, and police files. She called the public’s interest a “profound invasion of privacy” that would cause “irreparable harm.”

Judge Christopher Whitten ruled two pages of the police report could be redacted. “Its disclosure would serve no purpose other than satisfying morbid curiosity,” he wrote. Kiser’s lawyer said the decision protects “the dignity of a little boy whose memory should reflect the love and light he brought to the world.”
